If an item's correct price is lower than our stated price, we charge the lower amount. If an item's correct price is higher than our stated price, we will contact you for instructions or cancel your order and notify you of such cancellation. In case of wrong information had been provided LivingCancun.com will do its best efforts to correct the information, however, cannot be held responsible for indemnifications of inconveniences caused by such mistake. In these cases you have the option to cancel without any penalizations.
We make arrangements with suppliers who provide travel services such as but not limited to hotels, ground transportation, sightseeing or other activities included in your tour. Although we try our best to choose the most reputable suppliers, We cannot be held responsible for their acts and omissions. The travel services are subject to the conditions imposed by these suppliers, and their liability may, in turn, be limited by their tariffs and conditions of service. LivingCancun.com acts only in the capacity of agent for the client or for the supplier of the goods and services rendered and as such, mains no control over the personnel, equipment, operations or goods of the supplier.
LivingCancun.com will not assume responsibility for any claims, costs or expenses arising out of personal or third party injury, accidents or death, loss or damage of personal property, loss of enjoyment, upset, disappointment, distress or frustration, whenever physical or mental, resulting from any of the following: (a) The act or omission of any party other than LivingCancun.com or its employees; (b) Sickness, theft, labor disputes, mechanical breakdown, quarantine, government actions, weather, or any other cause beyond LivingCancun.com's direct control; (c) Your failure to obtain the documentation required for your trip such as, but not limited to, passports, visas and certificates, in which case you will also not be entitled to any refund; (d) Your failure to follow instructions including but not limited to airport departure times, check-in and check-out dates and times, voucher redemption policies; (e) Cancellation or change for any reason in the travel services offered. We reserve the right to cancel or change the travel services at our discretion, but will try to substitute comparable services. If we must completely cancel your reservation, LivingCancun.com's liability will be limited to a refund of all monies paid to LivingCancun.com; (f) A full refund, however, will not be honored in situations where travel must be cancelled, interrupted and/or postponed by LivingCancun.com for reasons which are beyond its control (force majeure situations, such as but not limited to weather, hurricane, earthquakes, acts of terrorism, etc.) and where LivingCancun.com's contractual obligations with its suppliers does not allow it to obtain reimbursement of the sum paid, or to be paid, to the supplier on behalf of the customer. In any case, a 10% administrational fee of the total amount of the reservation can be retained at the discretion of LivingCancun.com
LivingCancun.com herewith states that (a) Photographs shown are representational only and do not guarantee that everything will be exactly as depicted upon arrival; (b) Hotel and service star ratings are based on LivingCancun.com's interpretation and may differ from ratings reported elsewhere; (c) travel service descriptions are updated at the best of LivingCancun.com's knowledge but do not guarantee that everything will be exactly as described upon arrival; (d) LivingCancun.com reserves the right to decline any client at any time; (e) Written notice or any claim against LivingCancun.com must be received no later than fourteen (14) days after your return from your trip. |
